The notion of societal boundaries aims to enhance the debate on planetary boundaries. The focus is on capitalist societies as a heuristic for discussing the expansionary dynamics, power relations, and lock-ins of modern societies that impel highly unsustainable societal relations with nature. While formulating societal boundaries implies a controversial process – based on normative judgments, ethical concerns, and socio-political struggles – it has the potential to offer guidelines for a just, social-ecological transformation.

La contribution de Michel Troper à la théorie générale du droit et à la théorie constitutionnelle est aujourd'hui reconnue et célébrée un peu partout dans le monde. The planetary boundaries concept has profoundly changed the vocabulary and representation of global environmental issues. The article starts by highlighting the strengths and weaknesses of planetary boundaries from a social science perspective. It is argued that the growth imperative of capitalist economies, as well as other particular characteristics detailed below, are the main drivers of the ecological crisis and exacerbated trends already underway. Further, the planetary boundaries framework can support interpretations that do not solely emphasize technocratic operational approaches and costs, (...) but also assume that these alone can be the solution. New concepts may prove necessary to profit from the avalanche of sequence data on the genome, transcriptome, proteome and interactome and to relate this information to cell physiology. Here, we focus on the concept of large activity-based structures, or hyperstructures, in which a variety of types of molecules are brought together to perform a function. We review the evidence for the existence of hyperstructures responsible for the initiation of DNA replication, the sequestration of newly replicated origins of replication, cell division (...) and for metabolism. The processes responsible for hyperstructure formation include changes in enzyme affinities due to metabolite-induction, lipid-protein affinities, elevated local concentrations of proteins and their binding sites on DNA and RNA, and transertion. Experimental techniques exist that can be used to study hyperstructures and we review some of the ones less familiar to biologists. Finally, we speculate on how a variety of in silico approaches involving cellular automata and multi-agent systems could be combined to develop new concepts in the form of an Integrated cell (I-cell) which would undergo selection for growth and survival in a world of artificial microbiology. Résumé Confronté à l’orientation tendanciellement matérialiste des sciences de la nature dans le dernier tiers du xix e siècle, Hermann Cohen s’efforça d’offrir une fondation idéaliste de ces sciences en recourant à la philosophie transcendantale kantienne. Il fut en accord avec Friedrich Albert Lange dans le refus de toute métaphysique dogmatique, mais il ne partagea pas son naturalisme, et l’idéalisme poético-fictif qui le complétait. Alors que Lange, dans son Histoire du matérialisme, avait eu pour but de décrire l’autodissolution (...) de la métaphysique matérialiste, Cohen voulut montrer comment le matérialisme débouchait dans un idéalisme méthodique, de provenance kantienne. En fin de compte, la distance dans le temps par rapport à Lange s’accroissant, il en vint à prêter un tel idéalisme à Lange lui-même ; ce qui est problématique. (shrink)

Two approaches to elevating certain laws of nature over others have come to prominence recently. On the one hand, according to the meta-laws approach, there are meta-laws, laws which relate to laws as those laws relate to particular facts. On the other hand, according to the modal, or non-absolutist, approach, some laws are necessary in a stricter sense than others. Both approaches play an important role in current research, questioning the ‘orthodoxy’ represented by the leading philosophical theories of natural laws—Humeanism, (...) the DTA view, dispositional essentialism and primitivism. This paper clarifies the relations between these two emerging approaches, as well as their applicability to physical laws and the status of the challenges they pose for standard theories of laws of nature. We first argue that, despite some significant similarities between the two approaches (especially in the context of Lange’s counterfactual account of laws), they are in general distinct and largely independent of each other. Then, we argue that the support for meta-laws from physical theory and practice is more questionable than usually presented. (shrink)

The (...) rule and the struggle, the rule in the struggle, this is the juridical.” - Michel Foucault Penal Theories and Institutions is the title Michel Foucault gave to the lectures he delivered at the Collège de France from November 1971 to March 1972. In these lectures Michel Foucault presents for the first time his approach to the question of power that will be the focus of his research up to the writing of Discipline and Punish and beyond. His analysis starts with a detailed account of Richelieu’s repression of the Nu-pieds revolt and then goes on to show how the apparatus of power developed by the monarchy on this occasion breaks with the system of juridical and judicial institutions of the Middle Ages and opens out onto a “judicial State apparatus”, a “repressive system”, whose function is focused on the confinement of those who challenge its order. Michel Foucault systemizes the approach of a history of truth on the basis of the study of “juridico-political matrices” that he had begun in the previous year’s lectures and which is at the heart of the notion of “knowledge-power”. In these lectures Foucault develops his theory of justice and penal law. The appearance of this volume marks the end of the publication of the series Foucault’s courses at the Collège de France. Certain scientific explanations of physical facts have recently been characterized as distinctively mathematical –that is, as mathematical in a different way from ordinary explanations that employ mathematics. This article identifies what it is that makes some scientific explanations distinctively mathematical and how such explanations work. These explanations are non-causal, but this does not mean that they fail to cite the explanandum’s causes, that they abstract away from detailed causal histories, or that they cite no natural laws. Rather, in these explanations, (...) the facts doing the explaining are modally stronger than ordinary causal laws or are understood in the why question’s context to be constitutive of the physical arrangement at issue. A distinctively mathematical explanation works by showing the explanandum to be more necessary than ordinary causal laws could render it. It is often presumed that the laws of nature have special significance for scientific reasoning. But the laws' distinctive roles have proven notoriously difficult to identify--leading some philosophers to question if they hold such roles at all. This study offers original accounts of the roles that natural laws play in connection with counterfactual conditionals, inductive projections, and scientific explanations, and of what the laws must be in order for them to be capable of playing these roles. It is commonly thought that authors can make anything whatsoever true in their fictions by artistic fiat. Harry Deutsch originally called this position the Principle of Poetic License. If true, PPL sets an important constraint on accounts of fictional truth: they must be such as to allow that, for any x, one can write a story in which it is true that x. I argue that PPL is far too strong: it requires us to abandon the law of non-contradiction and (...) entails a radical revision of otherwise ordinary commitments about truth in fiction. (shrink)

Many philosophers argue that explanatoriness plays no special role in confirmation – that “inference to the best explanation” (IBE) incorrectly demands giving hypotheses extra credit for their potential explanatory qualities beyond the credit they already deserve for their predictive successes. This paper argues against one common strategy for responding to this thought – that is, for trying to fit IBE within a Bayesian framework. That strategy argues that a hypothesis’ explanatory quality (its “loveliness”) contributes either to its prior probability or (...) to its likelihood. This paper argues that this strategy fails because it must give different treatments to two hypotheses that are unlovely for the very same reason. The strategy therefore loses the insight into scientific reasoning that its reconstruction in terms of IBE is supposed to provide. The paper then provides a Bayesian account of the confirmatory role of explanatoriness that represents explanatory quality as having an impact in the same place for two hypotheses that are unlovely for the very same reason. This approach works by “putting explanation back into IBE” – that is, by invoking hypotheses that refer explicitly to scientific explanation and by invoking the agent's background opinions regarding the kind of explanation that the evidence is liable to have. On this approach, there is no list of “explanatory virtues” the possession of which always helps to make an explanation better. Rather, for different facts, there are different characteristics that our background knowledge of other explanations gives us some reason to expect the given fact's explanation to possess. (shrink)

Not all scientific explanations work by describing causal connections between events or the world's overall causal structure. In addition, mathematicians regard some proofs as explaining why the theorems being proved do in fact hold. This book proposes new philosophical accounts of many kinds of non-causal explanations in science and mathematics.

It has often been argued that Humean accounts of natural law cannot account for the role played by laws in scientific explanations. Loewer (Philosophical Studies 2012) has offered a new reply to this argument on behalf of Humean accounts—a reply that distinguishes between grounding (which Loewer portrays as underwriting a kind of metaphysical explanation) and scientific explanation. I will argue that Loewer’s reply fails because it cannot accommodate the relation between metaphysical and scientific explanation. This relation also resolves a puzzle (...) about scientific explanation that Hempel and Oppenheim (Philosophy of Science 15:135–75, 1948) encountered. (shrink)

The institution of the family and its importance have recently received considerable attention from political theorists. Leading views maintain that the institution’s justification is grounded, at least in part, in the non-instrumental value of the parent-child relationship itself. Such views face the challenge of identifying a specific good in the parent-child relationship that can account for how adults acquire parental rights over a particular child—as opposed to general parental rights, which need not warrant a claim to parent one’s biological progeny. (...) I develop a view that meets this challenge. This Project View identifies the pursuit of a parental project as a distinctive non-instrumentally valuable good that provides a justification for the family and whose pursuit is necessary and sufficient for the acquisition of parental rights. This view grounds moral parenthood in a normative relation as opposed to a biological one, supports polyadic forms of parenting, and provides plausible guidance in cases of assisted reproduction. This paper examines some recent attempts that use counterfactuals to understand the asymmetry of non-causal scientific explanations. These attempts recognize that even when there is explanatory asymmetry, there may be symmetry in counterfactual dependence. Therefore, something more than mere counterfactual dependence is needed to account for explanatory asymmetry. Whether that further ingredient, even if applicable to causal explanation, can fit non-causal explanation is the challenge that explanatory asymmetry poses for counterfactual accounts of non-causal explanation. Many philosophers endorse the Transparency Thesis, the claim that by introspection one cannot become aware of one's experience. Recently, some authors have suggested that the Transparency Thesis is challenged by introspective states reached under mindfulness. We label this the Mindfulness Opacity Hypothesis. The present paper develops the hypothesis in important new ways. First, we motivate the hypothesis by drawing on recent clinical psychology and cognitive science of mindfulness. Secondly, we develop the hypothesis by describing the implied shift in experiential perspective, (...) the scope of introspectable qualities, and the level of skill. Thirdly, we defend the hypothesis against various philosophical arguments. We conclude that the Mindfulness Opacity Hypothesis is empirically and theoretically well motivated and supported. (shrink)

The concept of transliminality (''a hypothesized tendency for psychological material to cross thresholds into or out of consciousness'') was anticipated by William James (1902/1982), but it was only recently given an empirical definition by Thalbourne in terms of a 29-item Transliminality Scale. This article presents the 17-item Revised Transliminality Scale (or RTS) that corrects age and gender biases, is unidimensional by a Rasch criterion, and has a reliability of .82. The scale defines a probabilistic hierarchy of items that address magical (...) ideation, mystical experience, absorption, hyperaesthesia, manic experience, dream interpretation, and fantasy proneness. These findings validate the suggestions by James and Thalbourne that some mental phenomena share a common underlying dimension with selected sensory experiences (such being overwhelmed by smells, bright lights, sights, and sounds). Low scores on transliminality remain correlated with ''tough mindedness'' in on Cattell 16PF test, as well as ''self-control'' and ''rule consciousness,'' whereas high scores are associated with ''abstractedness'' and an ''openness to change'' on that test. An independent validation study confirmed the predictions implied by our definition of transliminality. Implications for test construction are discussed. (shrink)

A conservation law in physics can be either a constraint on the kinds of interaction there could be or a coincidence of the kinds of interactions there actually are. This is an important, unjustly neglected distinction. Only if a conservation law constrains the possible kinds of interaction can a derivation from it constitute a scientific explanation despite failing to describe the causal/mechanical details behind the result derived. This conception of the relation between “bottom-up” scientific explanations and one kind of “top-down” (...) scientific explanation is motivated by several examples from classical and modern physics. The focus of this article is a question that has been neglected in debates about digitalization: Could machines replace human scientists? To provide an intelligible answer to it, we need to answer a further question: What is it that makes (or constitutes) a scientist? I offer an answer to this question by proposing a new demarcation criterion for science which I call “the discoverability criterion”. I proceed as follows: (1) I explain why the target question of this article is important, (...) and (2) show that it leads to a variant of the demarcation problem of science. (3) By arguing that it is probably an essential feature of science that we can make scientific discoveries, I suggest a novel way of dealing with this problem by proposing a new demarcation criterion. Before introducing it, (4) I analyze an exemplary case of a real scientific discovery, and (5) argue that scientific discovery processes have a general underlying structure. (6) I introduce my discoverability criterion for science and present my master argument that helps us understand which criteria have to be fulfilled in order to decide whether machines can replace human scientists or not. Background Moral distress is a phenomenon that can lead to an imbalance of the mind and body. There are many coping strategies to overcome the obstacles that lead the subject to this condition. Some coping strategies are capable of being achieved through the cultivation of moral resilience. Aim The aim is to identify the strategies of moral resilience in the nursing management of University Hospitals in Brazil. Research design The research design is the qualitative study with discursive textual analysis. Participants (...) and research context : 44 nurse managers and nurses in leadership positions participated in a total of 30 University Hospitals in Brazil. Data were collected online, using a questionnaire with open questions. Ethical considerations The Ethics Committee approved the study. Participants received information about the research, agreed to respond to the questionnaire, and were guaranteed anonymity. Findings Personal adaptive strategies (intrapersonal and interpersonal) and organizational collaborative strategies (intrinsic and transformational management) emerged from this process. The intrapersonal strategies involved elements of rationality, flexibility, rebalancing practices, moral courage, and detachment. The interpersonal strategies addressed support networks, team involvement, and dialog. Organizational strategies dealt with actions which reorient ethical infrastructure, ethical education, and psychological protection, as well as fostering dialogical relationships, empowerment, and cooperation. Conclusion From the perspective of social historical construction, it is understood that developing personal and organizational strategies is essential to cultivating moral resilience. (shrink)

According to Husserl, the epochè (or suspension of judgment) must be left incomplete. It is to be performed step by step, thus defining various layers of “reduction.” In phenomenology at least two such layers can be distinguished: the life-world reduction, and the transcendental reduction. Quantum physics was born from a particular variety of the life-world reduction: reduction to observables according to Heisenberg, and reduction to classical-like properties of experimental devices according to Bohr. But QBism has challenged this limited version of (...) the phenomenological reduction advocated by the Copenhagen interpretation. QBists claim that quantum states are “expectations about experiences of pointer readings,” rather than expectations about pointer positions. Their focus on lived experience, not just on macroscopic variables, is tantamount to performing the transcendental reduction instead of stopping at the relatively superficial layer of the life-world reduction. I will show that quantum physics indeed gives us several reasons to go the whole way down to the deepest variety of phenomenological reduction, may be even farther than the standard QBist view: not only reduction to experience, or to “pure consciousness,” but also reduction to the “living present.”. Philosophers who regard some mathematical proofs as explaining why theorems hold, and others as merely proving that they do hold, disagree sharply about the explanatory value of proofs by mathematical induction. I offer an argument that aims to resolve this conflict of intuitions without making any controversial presuppositions about what mathematical explanations would be.

This book’s basic argument is that the Freudian unconscious, far from constituting a radical break with the philosophy of consciousness, is merely the latest exemplar in a heritage of philosophical misunderstanding of the Cartesian cogito that interprets “I think, therefore I am” as “I represent myself, therefore I am” (in the classic interpretation of Heidegger, one of the targets of the book).

Why do forces compose according to the parallelogram of forces? This question has been controversial; it is one episode in a longstanding, fundamental dispute regarding which facts are not to be explained dynamically. If the parallelogram law is explained statically, then the laws of statics are separate from and “transcend” the laws of dynamics. Alternatively, if the parallelogram law is explained dynamically, then statical laws become mere corollaries to the dynamical laws. I shall attempt to trace the history of this (...) controversy in order to identify what it would be for one or the other of these rival views to be correct. I shall argue that various familiar accounts of natural law not only make it difficult to see what the point of this dispute could have been, but also improperly foreclose some serious scientific options. I will sketch an alternative account of laws that helps us to understand what this dispute was all about. (shrink)

Precise measurements of well-being would be of profound societal importance. Yet, the sceptical worry that we cannot use social science instruments and tests to measure well-being is widely discussed by philosophers and scientists. A recent and interesting philosophical argument has pointed to the psychometric procedures of construct validation to address this sceptical worry. The argument has proposed that these procedures could warrant confidence in our ability to measure well-being. The present paper evaluates whether this type of argument succeeds. The answer (...) is that it depends on which methodological background assumptions are motivating the sceptical worry to begin with. We show this by doing two things. First, we clarify (a) the different types of well-being theories involved in the science of well-being, and (b) the general methodological dimensions of well-being theorising. Second, we apply these distinctions and argue that construct validation is an unsuccessful response to measurement scepticism if this scepticism is motivated by a form of methodological non-naturalism. In the light of this, the overall point of the paper is that philosophers and scientists, when discussing measurement of well-being, should explicate their deeper methodological commitments. We further suggest that making such explicit commitments might present philosophers with a dilemma. (shrink)

Clinical psychologists describe decentering as the mental operation in which a subject “moves out” of immersion in a mental state. Such decentering is philosophically puzzling. It involves that a subject attends to her mental state to distance herself from it. That is, she attends to the state to make it less determining of her processing. This paper provides a philosophical explanation of the nature of decentering. It analyses decentering as a complex mental operation composed of two sub-operations: introspection and detachment. (...) Drawing on this analysis, the paper argues that decentering involves certain dynamics of attention and attention control that pose an important challenge to a selection for action theory of attention. This challenge concerns adequately describing the workings of detachment in decentering. The paper discusses how a selection for action theory might reply, yet it argues that all the available replies involve unattractive aspects. The paper closes with broader perspectives, suggesting that decentering might also pose a puzzle for other theories of attention. (shrink)
